Terms of Service

1. The Service

StockPhotoTags uses AI to generate titles, descriptions and keywords for photos and videos, and to export them in formats used by stock marketplaces. Processing consumes prepaid "credits" (1 credit = 1 media file).

2. Your account

• You must provide accurate information and keep your login credentials secure.
• You are responsible for all activity under your account.
• Accounts are for a single user; please don't share them.
• You must be at least 18 years old (or the age of majority where you live).

3. Credits & payments

• Credits are prepaid; 1 credit processes 1 image or video.
• Credits do not expire and are non-transferable.
• New accounts receive complimentary credits so you can try the Service first.
• Prices and pack contents may change; changes never affect credits you've already purchased.
• Payments are handled by our third-party payment provider. We never see or store your full card details.

4. Acceptable use

You agree that you will:

• only upload content you own or are authorised to use;
• not upload unlawful, infringing, or prohibited material;
• not attempt to disrupt, overload, reverse-engineer, or gain unauthorised access to the Service.

We may suspend or close accounts that break these rules.

5. AI-generated output

Metadata is generated automatically and provided "as is". It may contain errors or omissions. You are responsible for reviewing and editing it before use. We don't guarantee that any marketplace will accept your submissions, or any particular sales outcome.

6. The browser tools (Unlimited Tagger and Image to prompt)

The Unlimited Tagger produces the same four fields as credit-based tagging, and Image to prompt turns a photograph into a generation prompt or a written description. Both require an active subscription, and in both the models run inside your own browser. That difference has consequences worth stating plainly:

• Your images are not uploaded. They are read, analysed and displayed entirely on your device. We never receive them, so we cannot store, inspect or recover them. When you press Download, only the finished text is sent to us to be formatted into a marketplace CSV, and it is discarded once the file is written.
• Nothing is saved. No album is created and no result is written to your account. Refreshing or closing the page loses the work.
• The output is yours to use commercially. Titles, descriptions, keywords, categories, prompts and descriptions generated by these tools may be sold and submitted to any marketplace on the same footing as metadata produced with credits. We claim no rights in them.
• The models permit it. These tools use openly licensed models — OpenAI’s CLIP and Microsoft’s Florence-2 under the MIT licence, with the ONNX Runtime (MIT) and Transformers.js (Apache 2.0). These licences allow commercial use and place no restriction on what the models generate. Their licence texts are distributed with the model files.
• Accuracy remains your responsibility. Output from these tools is subject to section 5 in full. It is less accurate than credit-based tagging and should be reviewed before publication; an inaccurate title, description or keyword on a marketplace listing is the seller’s responsibility, not ours.

Availability of these tools is not guaranteed and they may be limited, changed or withdrawn at any time. Their per-run image limits and any other restrictions shown on the page form part of these Terms. Access requires a current subscription; "unlimited" in the Unlimited Tagger's name means it consumes no credits however much you use it, not that a single run is unbounded.

7. Your content and intellectual property

• You keep all rights to the media you upload and to the metadata generated for you.
• We keep all rights to the Service itself (software, design, branding).
• You grant us a limited license to process your uploads solely to provide the Service, including sending them to our AI provider for analysis. This does not apply to the browser tools, where your images never leave your device (section 6).

8. Availability

We work to keep the Service running but provide it "as is" and "as available", without warranties of uninterrupted or error-free operation.

9. Limitation of liability

To the maximum extent permitted by law, our total liability for any claim relating to the Service is limited to the amount you paid us in the three (3) months before the claim. We are not liable for indirect or consequential losses, including lost profits or lost sales.

10. Termination

You may stop using the Service and delete your account at any time. We may suspend or close accounts that breach these Terms.

11. Changes

We may update these Terms; material changes will be reflected by the "last updated" date above and, where appropriate, notified to you.

12. Governing law

These Terms are governed by the laws of India, and the courts of Kollam, Kerala, India shall have jurisdiction, subject to any mandatory consumer protections in your country of residence.
